2.8 E-Verify
Overview
E-Verify is a federal, internet-based system operated by the U.S. Department of Homeland Security (DHS) in partnership with the Social Security Administration (SSA). It allows enrolled employers to electronically confirm the employment eligibility of newly hired Team Memberss by comparing information provided on Form I-9 to federal records.
Current Status at THE COMPANY
At this time, THE COMPANY is not required by Georgia law to participate in the E-Verify program because it employs 10 or fewer employees under its Federal Employer Identification Number (FEIN). THE COMPANY may voluntarily adopt E-Verify or may be required to participate in the future if:
- The total number of employees under the FEIN reaches 11 or more,
- THE COMPANY enters into a qualifying contract with a public employer in Georgia, or
- Federal or state law requires participation for any other reason.
Future Trigger Clause – Automatic Update
If participation becomes mandatory or THE COMPANY elects to voluntarily adopt E-Verify, this section of the handbook will automatically take effect. Team Members will be notified in writing on the Team Member Portal of the effective date.
How E-Verify Works
- After completing Form I-9, THE COMPANY (if enrolled) will enter the team member’s information into the E-Verify system.
- The system compares that information with federal records to confirm identity and work authorization.
- Most cases return an immediate confirmation. In some cases, the system may issue a Tentative Nonconfirmation (TNC) if the information does not match government records.
Team Member Rights in E-Verify
- If a TNC is issued, Team Members will be promptly notified and given the opportunity to contest the mismatch.
- Team Members may continue working while contesting a TNC, and no adverse action will be taken during this process.
- If the mismatch is not resolved and a Final Non-confirmation is issued, employment may be terminated as required by law.
- Team Members may not be asked to use specific documents or face selective application of E-Verify.
Non-Discrimination
THE COMPANY will not use E-Verify to discriminate based on citizenship, immigration status, national origin, race, or any other protected characteristic. E-Verify, if used, will apply equally to all new hires.
Recordkeeping
If THE COMPANY participates in E-Verify, all case results, notices, and related documents will be retained and stored with Form I-9 records in accordance with federal law.
